General Conditions of Sale

These General Terms and Conditions of Sale apply, without restriction or reservation, to any transaction between IBC MONACO and consumers and non-professional customers (“Customers”) as part of meeting room booking via the platform/website
The main features of the Services are presented on the platform/website
The Customer is required to read them before any order is placed. The choice and purchase of a Service is the sole responsibility of the Customer.
These conditions apply to the exclusion of all other conditions, including those applicable to other channels for marketing the Services.
They may be supplemented by special conditions, set out on the website, before any transaction with the Customer.
These General Conditions of Sale are accessible at any time on the website and will prevail, if applicable, over any other version or any other contradictory document.
Unless otherwise proven, the data recorded in the service provider’s IT system shall constitute proof of all transactions concluded with the Customer.
In accordance with Article 13 of Law No. 1.165, the Customer has the right to object, to access and to modify the processing of his personal data by writing, by mail or email, proving his identity, to:

The Customer declares that he has read these General Conditions of Sale and accepted them by ticking the box provided for this purpose before the implementation of the online ordering procedure.
The validation of the Services order by the Customer constitutes acceptance without restriction or reservation of these General Conditions of Sale.
The Client acknowledges that it has the capacity required to contract and acquire the Services offered on the platform/website
As these General Conditions of Sale may be subject to subsequent modifications, the version applicable to the Customer’s purchase is that in force on the website at the time of placing the order.
The Services presented on the platform/website are available for sale for the following territories: Principality of Monaco, France and more generally, Europe.
The Customer selects on the site the services he wishes to order, according to the following methods:
Selection of a meeting room, day and schedule,
Order validation,
Validation method of payment,
Order confirmation by IBC MONACO.
The contractual information is presented in English or French and is confirmed by the Customer at the latest when the order is validated.
The registration of an order on the Service Provider’s website is carried out when the Customer accepts these General Conditions of Sale by ticking the box provided for this purpose and validating his order.
The Customer has the possibility to check the details of his order, its total price and to correct any errors before confirming his acceptance.
This validation implies the acceptance of all these General Conditions of Sale and constitute proof of the sales contract.
It is therefore up to the Customer to verify the accuracy of the order and to report any error immediately.
The sale of the Services shall not be considered final until the confirmation of acceptance of the order by the Service Provider has been sent to the Customer by e-mail and after the Service Provider has cashed in the entire price.
Any order placed on the platform/website constitutes the formation of a contract concluded remotely between the Customer and the Service Provider.
IBC MONACO reserves the right to cancel or refuse any order of a Customer with whom there is a dispute concerning the payment of a previous order.
When an order is validated more than 3 days before the date of the service, the Customer benefits from the right of withdrawal provided by Sovereign Order No. 6.702 of 7 December 2017. The ordered service will be cancelled free of charge.
When an order is validated less than 3 days before the date of the service, the Customer expressly waives its right of withdrawal.
The following penalties will be applied:
Cancellation on D-2 of the service: 25% of the ordered service
Cancellation on D-1 of the service: 50% of the ordered service
Same day cancellation: 100% of the ordered service
The Services offered by IBC MONACO are provided at the rates in force on the platform/website
These tariffs are firm and cannot be revised during their validity period, as indicated on the platform/website
An invoice is drawn up by the Service Provider and delivered to the Customer when the Services ordered are provided.

The price is payable in cash, in full on the day of the placing of the order by the Customer, according to the terms specified in the article «Orders» above, by secure payment by bank cards: Bank Card, Visa, MasterCard, American Express, other bank cards.
Payment by credit card is irrevocable, except in case of fraudulent use of the card. In this case, the Customer may request the cancellation of the payment and the refund of the corresponding sums.
Payment data is exchanged in encrypted mode using HTTPS/SSL.

The content of the platform/website is the property of IBC MONACO.
It is protected by Monegasque and international intellectual property laws.
Any total or partial reproduction of this content is strictly prohibited and is likely to constitute an infringement offence.

The Parties may not be held liable if the non-performance or delay in the performance of any of their obligations, as described herein, results from a case of force majeure.

These General Conditions of Sale and the transactions resulting therefrom are governed by Monegasque law.
They are written in French. In the event that they are translated into one or more languages, only the French text shall be authentic in the event of a dispute.

All disputes to which the purchase and sale transactions concluded under these general conditions of sale may give rise, concerning their validity, their interpretation, their performance, their termination, consequences and consequences, which could not have been resolved between the seller and the customer, shall be submitted to the competent courts of the Monegasque civil order under ordinary law.

The Customer acknowledges having been informed, prior to the placing of his order and the conclusion of the contract, in a legible and understandable way, of these General Conditions of Sale and in particular the following information:
The essential characteristics of the Services, taking into account the communication medium used and the Service concerned,
the price of the Services and related charges,
Information on legal and contractual guarantees and their implementation methods;
Means of payment accepted.
The fact that a natural (or legal) person orders on the Platform/website implies full acceptance and acceptance of these General Conditions of Sale and obligation to pay for the Services ordered, which is expressly recognised by the Customer.
